HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Tr.C.M.P.Nos.734 and 740 of 2016 COMMON ORDER :

These two petitions under Section 24 of the Code of Civil Procedure, 1908, are filed by the wife requesting to withdraw F.C.O.P.Nos.1279 of 2011 and 1063 of 2012 pending on the file of the Family Court, Hyderabad, and transfer the same to the Family Court, Ranga Reddy, on the ground that she is presently staying at H.No.5-102, Road No.10, Bhavani Nagar, Dilsukhnagar, Hyderabad, pursuant to the orders passed by a competent Court in a Domestic Violence case filed against the respondent. I have heard the submissions of Sri B.Shashidhar, learned counsel for petitioner and Sri K.Saibabu, learned counsel for respondent/husband and perused the material record.

Though counter is filed by the respondent/husband denying the allegations and resisting requests in both the petitions of the wife, at the hearing, it is fairly stated that without prejudice to the rights and contentions of both the parties, the request in the petitions of the wife may be considered to meet the ends of justice.

Having regard to the submissions, both the petitions are ordered and F.C.O.P.Nos.1279 of 2011 and 1063 of 2012 are withdrawn from the file of the Family Court, Hyderabad, and are transferred to the Family Court, Ranga Reddy, for trial and disposal either jointly or simultaneously in strict accordance with the procedure established by law.

MSRM, J Tr.CMP.Nos.734 & 740 of 2016 Considring the fact that the O.Ps. are of the years 2011 and 2012, the transferor Court is directed that the transferor Court shall forthwith submit the duly indexed records to the transferee Court and that the transferee Court, on such receipt of records, shall endeavour to dispose of the said OPs as expeditiously as possible and preferably within three months from the date of receipt of the records by conducting either joint trial or simultaneous trials as per its convenience and the convenience of the parties.
