This writ petition is filed to declare the action of the respondents 1 to 4 in registering the documents in favour of third parties in respect of D.No.7A-9-53, Main Bazaar, Eluru, West Godavari District, since the matter is in subjudice in CMA.No.393/2010 on the file of this Court as illegal and arbitrary. Heard Sri Gangaiah Naidu, learned Senior Counsel for the petitioner.
It is for the petitioner to approach Civil Court for injunction, when a civil suit is pending. The petitioner cannot avail parallel remedies simultaneously i.e. one by way of filing civil suit and another approaching this Court by way of filing writ petition. Therefore, I do not find any reason to entertain the writ petition and the same is accordingly dismissed with liberty to the petitioner to obtain orders from the concerned civil Court, where the proceedings are pending. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
