Smt. Puvvada Mallikamba, v. State Of Andhra Pradesh, Rep.By Its Principal Secretary -
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 25087 of 2016 O R D E R:
The petitioner claims to have purchased an extent of Ac.0.23 cents in Survey No. 81 of Krishnapuram Village, Pamidimukkala Mandal, Krishna District vide registered sale deed dated 31.01.1989. While so, on 20.06.1996, her property has been demarcated as Survey No. 81/1, which fact was also borne out by the records maintained under Board Standing Order 34A. At this juncture, the petitioner submits that in the Adangals, the property in Survey No. 81, comprising of Acs.2.27 cents, was shown as Zilla Parishad Road. As a matter of fact, out of the said extent, only Ac.0.80 cents is agricultural land, which includes Ac.0.23 cents (survey No.81/1), owned by the petitioner.
Pursuant to the demarcation, the revenue records were not amended, hence, the revenue officials have not been issuing any pattadar passbooks on the ground that the subject land has been shown as 'donka' at column No. 6 and as 'ZP Road' at column No. 12. While the matter stood thus, against the endorsement dated 10.06.2015 passed by the 4th respondent, the petitioner filed Writ Petition No. 24763 of 2015, wherein this Court gave a direction to file an Appeal before the authority concerned in relation to her grievance. Though the Appeal has been preferred, the 3rd respondent has not considered the same. Questioning the said inaction, the petitioner filed another Writ Petition No. 29354 of 2015.
This Court directed the 3rd respondent to fix an early date to hear the appeal and pass appropriate orders, pursuant to which direction, the 3rd respondent advised the petitioner to approach the 2nd respondent District Settlement Officer/Joint Collector by way of an Appeal. The petitioner has also made an Application under the Right to Information Act to ascertain the status of the Appeal.
impugned endorsement dated 31.12.2015 directing her to file an Appeal before the 2nd respondent. Accordingly, the petitioner filed an Appeal before the 2nd respondent in October 2015, but till now, no orders have been passed thereon. Hence, this Writ Petition. Heard learned counsel for the petitioner as well as learned Government Pleader for Revenue (Andhra Pradesh). From a perusal of the affidavit filed in support of the Writ Petition, it appears, the limited grievance of the petitioner is that the Appeal said to have been preferred by her in October 2015 has not been considered by the 2nd respondent.
In that view of the matter, it would suffice if a direction is issued to the 2nd respondent to consider the Appeal preferred by the petitioner in October 2015 and pass orders considered appropriate within a period of 12 weeks from the date of receipt of a copy of this order. Ordered accordingly.
With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous petitions, if any shall also stand disposed of.
