ORAL ORDER:

Petitioner earlier filed W P No. 4456 of 2018 challenging the order of Tahsildar dated 2.1.2018 canceling the assignment dated 8.5.2005. When the said writ petition was taken up for consideration, learned Assistant Government Pleader raised objection on maintainability of writ petition as petitioner has an effective alternative remedy by way of appeal. Learned counsel for petitioner also expressed willingness to file appeal. Having regard to the same, said writ petition was disposed of granting liberty to petitioner to file appeal within four weeks from 12.2.2018 and respondents were directed to maintain status quo as regards possession and enjoyment of the subject matter of the litigation for a period of eight weeks. Petitioner was also granted liberty to obtain further orders from the appellate authority.

Petitioner filed appeal along with an interlocutory application to grant interim order. Alleging that so far appeal is not disposed of and no orders are passed on the interlocutory application, once protection granted by this Court has expired, this writ petition is filed. 3.

Having regard to the earlier directions of this Court and fact that petitioner has already preferred appeal on 24.2.2018 along with application to grant interim order, till the orders are passed by the Revenue Divisional Officer on the interlocutory application filed by petitioner, earlier status quo order granted on 12.2.2018 in W P No. 4456 of 2018 shall continue.
