W.P.No.2681 of 2009 ORDER:

This writ petition filed under Article 226 of the Constitution of India challenges the action of the respondents in not considering the representation dated 7.11.2008 said to have been submitted by the petitioners for grant of permission for sub-division and construction in the land situated in Sy.No.129/97 (old) of Shaikpet village and mandal, Hyderabad District as illegal, arbitrary, unjust, discriminatory and against the principles of natural justice.

2. Heard the learned counsel for the petitioners and the learned Standing Counsel for Respondents 1 and 2 and the learned Government Pleader for Respondents 3 and 4, apart from perusing the material available on record.

3. While ordering rule nisi on 17.2.2009, this court in W.P.M.P.No.3423 of 2009 granted interim order directing the Respondents herein to receive and consider the application of the petitioner dated 7.11.2008 for grant of permission for sub-division and construction in the land in Sy.No.129/97 (old) of Shaikpet village and mandal.

4. No counter affidavit has been filed by the respondents in the direction of denying the averments made in the affidavit filed in support of the writ petition.

5. According to the learned counsel for the petitioner despite the interim orders granted by this Court on 17.2.2009, no orders have been passed on the said representation of the petitioner dated 7.11.2008.

6. In view of the same, without expressing any opinion on merits of the matter, this Court deems it appropriate to dispose of the writ petition directing the respondents to

pass appropriate orders on the said representation of the petitioner dated 7.11.2008 in accordance with law.

7. For the aforesaid reasons, the writ petition is disposed of directing the Respondents hereinto pass appropriate orders on the representation said to have been submitted by the petitioner on 7.11.2008, in accordance with law, within a period of four weeks from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
