THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.27483 of 2011 ORDER:

The grievance of the petitioner was that the Station House Officer, Edlapadu Police Station, Guntur District, the 3rd respondent herein, was not conducting and completing the investigation in Crime No.49 of 2011 on the file of the said police station. Crime No.49 of 2011 was registered under Sections 420, 471 and 506 I.P.C. read with Section 34 I.P.C. upon the complaint made by the petitioner. Respondents 4 to 9 herein were shown as the accused in the said crime.

Relying on the written instructions dated 15.09.2015 received from the Assistant Sub-Inspector of Police, Edlapadu Police Station, Guntur Rural District, the learned Assistant Government Pleader for Home informed this Court that the police authorities investigated Crime No.49 of 2011 and found that the dispute was purely civil in nature. Upon the written instructions dated 25.01.2014 of the Sub-Divisional Police Officer, Narasaraopet, a final report under Section 173 Cr.P.C. was filed before the learned Additional Junior Civil Judge, Chilakaluripeta, referring the case as 'civil in nature' on 02.08.2015. Intimation to that effect was also said to have been sent to the petitioner by registered post with acknowledgment due but the same was returned on 01.08.2015 with the endorsement that the petitioner was not residing at the village.

In the light of the afore-stated developments, it is for the petitioner to take recourse to appropriate remedies in accordance with law if she is aggrieved by the final conclusion arrived at by the police authorities.

Reserving liberty to the petitioner to do so, the writ petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
