This writ petition is filed challenging the action of the respondents 2 and 3 in not registering the FIR pursuant to the complaint of the petitioner dt.14.06.2018 and 28.04.2018.
The 3rd respondent filed counter affidavit stating that he had enquired the complaints of the petitioner dt.14.06.2018 and 28.04.2018 and tried to secure the presence of the petitioner at the given address, but at that time, the petitioner was not available at home; that the preliminary enquiry with village elders revealed that there is a civil dispute between the petitioner and respondents 4, 5 & others with regard to the subject land in OS.No.91/2017 filed by the petitioner; and that whenever the petitioner approaches respondent No.3 along with relevant documents, necessary action will be taken.
Learned counsel for the petitioner states that the petitioner will file necessary documents; and that the writ petition can be disposed of with a direction to respondents to take action on the complaint of the petitioner. Having regard to the aforesaid facts and circumstances, it is open for the petitioner to submit relevant documents as required by the respondents and on submission of the said documents by the petitioner, the respondent police shall take appropriate action, in accordance with law, within two weeks from the date of submission of documents by the petitioner.
Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
