Heard learned counsel for the petitioners/A1 and A.2 of Crime No.73 of 2013 of Yadagirigutta Police Station, registered for the offences punishable under Sections 403, 405, 415, 464, 468, 506 and 420 read with 34 IPC, which is outcome of the private complaint of the 1st respondent/de facto complainant dated 04.03.2013 referred to the police under Section 156(3) Cr.P.C. by the learned Additional Judicial First Class Magistrate, Bhongir in the averments therein that in the family partition between A1 and the de facto complainant dated 08.10.1997 enclosed as document No.1 copy of it, an extent of Ac.6.31 gts in Survey No.108 fallen to the share of de facto complainant, whereas Ac.0.13 gts fallen to the share of A1 and he came to know that A1 executed copy enclosed document No.3, Gift Deed dated 19.01.2012 as if got created an extent of Ac.3.

22 gts in Survey No.108 though in the family partition fallen only 0.13 gts and managed the revenue authorities to tamper the revenue record in creating and altering as if the property by virtue of the so called fraudulent gift in position. Once that is the sum and substance of the accusation there is nothing to interdict the investigation, but for to say as the crime is of the year 2013, the police shall complete the investigation as early as possible and pending investigation not to arrest the petitioners. However, it will not preclude the police to secure the presence of the witnesses for the purpose of further investigation. Accordingly, the criminal petition is disposed of.
