( Respondents in-do-) ,/ Petition under Section 482 of Cr.P.C. praying that in the.circumstances stated in the memorandum of grounds filed therein, the High Court may be pleased to relax the condition of personal appearance of the petitio ner/accu sed before the P.S. C.B.C.I.D, Hyderabad., regularly, as per the orders passed in Crl.P.No.4111 OF 2018 dt. 03.07.2018 and subsequent modification, in relation to the Crime No.583 of 2016, on the file of P.S. C.B.CID, Hyderabad. Crl.P.No. 4111 of 2018:

Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the memorandum of grounds filed therein, the High Court may be pleased to grant Anticipatory Bail by directing the Respondent to release the Petitloner on Bail in the event of his Arrest in Crime No. 583 of 2016 of Hyderabad CID Police Station. The petition coming on for hearing, upon perusing the petition/and the grounds filed herein and the order of the High Court dated 03-07-2018 made in Crl.P., order dated 31.07.2018 made in IA No.2 of 2018 and upon hearing the arguments of Amancharla V, Gopala Rao, Advocate for the Petitioner and the Public Prosecutor for the Respondent, the Court made the following

ORDER

This application is filed seeking to relax condition imposed by this Court in the order dated O3,O7.2O18 in Crl.P,No.4l11 of 2018 with regard to appearance of the petitioner before the Station House Officer concerned on every alternate day till filing of the charge sheet and thereafter once in a month on 1't Sunday till completion of trial/enquiry between 5.0O PM nad 6.00 PM.

Learned counsel for the petitioner would submit that the petitioner has been complying with the order dated 03.07.2018 in Crl,P,No.4111 of 2018, According to him, the .Police have almost completed the investigation, Learned Public Prosecutor would submit that the investigation is still pe nd ing, This Court, vide order dated 03,07,2018 in Crl,P.No,4111 of 2018, imposed a condition that the petitioner shall attend the Station House Officer concerned on every alternate day till filing of the charge sheet and

I thereafter once in a month on lst Sunday till completion of trial between 5.OO PM and 6.OO PM. Thereafter, in I.A.No.6 of 201a in Crl.P.No.4111 of 2018, vide order dated 25.09.2018, modified the condition directing the petitioner to attend once in a month either on 1't Sunday or any such other date fixed by the Investigating Officer before the respective CBCID investigating officials of the 7 regional offices of State of Andhra Pradesh and such regional offices of State of Telangana respectively till end of trial. In the similar circumstances, this Court in LA.No.1 of 2O2O in Crl.P.No.10687 ot 2O2Ot dated 18.O8.2O20, relaxed the said condition of appearance of the petitioner therein.

Considering the above, this application is allowed relaxing the condition imposed by this Court vide order dated 25.09.2018 in I.A.No.6 of 2018 with regard to appearance of the petitioner/accused before the concerned Station House Officer once in a month either on l't Sunday or any other date fixed by the Investigating Officer before the respective CBCID investigating officials of the 7 regional offices of State of Andhra Pradesh and such regional offices of State of Telangana respectively till end of trial, is hereby relaxed. However, the petitioner shall appear before the concerned Station House Officer as and when his presence is required. It is made clear that other conditions imposed in the order dated 25.09.2018 in I.A,No.6 of 2018 in Crl,P.No.4111of 2018 remain unaltered.
