Petitioner prays for Mandamus declaring the action of respondent in denying the affiliation and not including the college of the petitioner for admission into the under graduation of B.Sc. (Agriculture) and B.Sc. (Hons) Horticulture courses in the ongoing counseling for the colleges having affiliation to respondent university and Dr. Y.S.R.H.U for the year 2016 and 2017 despite submission application on 21.10.2016 for affiliation pursuant to notification dated 30.09.2106 as illegal, arbitrary and unconstitutional. 3.

Petitioner on the supposition that the application dated 21.10.2016 is compliant and non-consideration of petitioner college either for affiliation or admission of students for academic year 2016-17 has filed the instant writ petition.

Learned standing counsel for respondent at the time of hearing placed on record Lr.No.2156/ Acad/ 2016 dated 26.11.2016. The letter reads thus:

Sub: ANGRAU - EoI for affiliation of Private Agricultural Colleges - Information on the Status of EvaluationRegarding Ref: EoI application dated 21.10.2016 * * * With reference to the application of Expression of Interest, I regret to inform that the application is rejected based on Evaluation Procedures as mentioned below. The Preliminary evaluation Committee constituted by the University for scrutinizing the applications received under Expression of Interest for establishment of Private Agricultural Colleges with an affiliation to ANGRAU has rejected application on the following grounds.

1. The required land of 110 acres is not registered in the name of the Society. (As per the requirements, the entire land should be registered in the name of Society, item No.2.2 of the EoI).

2. The minimum deposits of Rs.300,00,000/ - are required in the name of the Society as a proof of operational expenses (item no.2.3 of the EoI) but the Charity has an amount of Rs.26,53,000/ - only.

Having regard to the fact that the respondent, on scrutiny of the application dated 21.10.2016, has rejected the application of petitioner for affiliation, this Court is of the view that the petitioner has to work out the remedies available against communication dated 26.11.2016. Having seen the writ prayer and the communication placed by the learned standing counsel on record, I am not inclined to exercise jurisdiction of this Court under Article 226 of the Constitution of India. By granting liberty to petitioner to assail the communication dated 26.11.2016, the writ petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
