THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No. 24168 OF 2013 O R D E R : (per Hon'ble Sri Justice Nooty Ramamohana Rao) None appears for the petitioner even today. There is also no representation when the name of the petitioner is called out. Even on the previous occasion, when the matter is taken up on 10.03.2016, there was no representation.

On behalf of the 1st respondent State Bank of Hyderabad, it was brought to our notice that an interlocutory order that was passed in this Writ Petition on 21.08.2013 directing the petitioner herein to deposit a sum of Rs. 20 lacs with the 1st respondent bank within a period of three weeks, has not been complied with so far. More than 2 1⁄2 years' time has elapsed since 21.08.2013. Because of the stay granted by this Court, the respondent bank is finding it difficult to proceed further in the matter. Further, when the parties expressed a desire to resolve the dispute satisfactorily before the Lok Adalat, we referred the matter to the High Court Lok Adalat. The petitioner did not appear before the Lok Adalat in spite of information relating to listing of the matter before the Lok Adalat, being made available. As a result, the Lok Adalat has also returned the papers back to the Registry, as the parties, obviously by their conduct, exhibited lack of interest to settle the dispute amicably.

In fact, nearly couple of years back, i.e. on 10.03.2014, the Division Bench, noticing the default committed by the petitioner, dismissed W.P.M.P.No. 29729 of 2013.

In view of what has been noticed by us, we infer that the writ petitioner has no sustaining interest to prosecute this Writ Petition.

Accordingly, this Writ Petition stands dismissed for non-prosecution, after hearing Sri Ambadipudi Satyanarayana, learned Standing Counsel for the respondent bank. No costs.

Consequently, the miscellaneous applications, if any shall also stand dismissed.
