ORAL ORDER:

Petitioner is Constable in TSRTC. While working in Sirsilla depot, he was placed under suspension. On revocation of the suspension, he was transferred and posted to Manuguru depot in Khammam district. Petitioner went and joined duty at Manuguru depot. While working in Manuguru depot, the transfer order was modified and petitioner was shifted to Kamareddi depot by order dated 6.1.2017. Challenging the order of transfer to Kamareddi, this writ petition is filed.

The transfer is challenged primarily on the ground that the post of Constable is organized on regional basis and transfer can be made within the region, whereas, Kamareddi falls in a different region, thus, his transfer means transfer to different unit of appointment.

Learned standing counsel, informs the Court that by order dated 19.1.2017, the earlier transfer to Kamareddi is modified and petitioner was transferred to Manthani, where petitioner has not joined. 4.

In response, learned counsel for petitioner contends that order dated 19.1.2017 is not served on petitioner and petitioner is not aware of the said order, therefore he has only challenged the order of transfer to Kamareddi dated 6.1.2017. He further submitted that there are vacancies in other depots within the same region, i.e., Kourutla and Sirsilla and if petitioner could not be accommodated in Sirsilla, he may be shifted to any other place where vacancies are available within the region.

Having regard to the peculiar facts of this case, opportunity is granted to the petitioner to make a representation within one week from today addressed to Director Vigilance and Security-second respondent and as and when such a representation is made, same shall be considered and request of the petitioner

for accommodation may be considered and appropriate decision may be taken. The decision should be made and communicated to the petitioner within two weeks from the date of receipt of the representation from the petitioner. In view of the frequent transfers, opportunity is granted to petitioner to apply for leave till decision is made. No costs.
