Heard.

The grievance of the petitioners in this Civil Revision Petition is non-disposal of I.A.No.1279 of 2013 in a first appeal filed by the petitioners on the file of the Court of the Senior Civil Judge, Chirala, Prakasham District. The respondent herein instituted O.S.No.242 of 2003 on the file of the court of the Principal Junior Civil Judge, Chirala for mandatory injunction. The learned

Principal Junior Civil Judge decreed the said suit on 5.11.2003. Against the said judgment and decree, the petitioners herein filed Appeal Suit on the file of the Court of the Senior Civil Judge, Chirala, Prakasam District. In the said appeal, the petitioners herein filed the present I.A.No.1279 of 2013 on 22.7.2013, seeking condonation of delay in representing the appeal. According to the petitioners, the said application is pending consideration before the lower appellate Court. Taking into consideration the totality of the circumstances of the case, this Court deems it appropriate to dispose of the present Civil Revision Petition by directing the lower appellate Court to pass appropriate orders in I.A.No.1279 of 2013 by fixing a time frame.

For the aforesaid reasons, the Civil Revision Petition is disposed of, directing the Court of Senior Civil Judge, Chirala to dispose of I.A.No.1279 of 2013 within a period of one month from the date of receipt of copy of this order. Miscellaneous applications, if any pending in the Civil Revision Petition, shall stand closed. No costs.
