THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.7247 of 2012 ORDER:

As there was no representation for the petitioner on 17.11.2015 the matter was directed to be listed under the caption 'For Dismissal'. Despite listing the matter under the caption 'For Dismissal', there is no representation for the petitioner. It indicates that the petitioner is not interested in prosecuting the writ petition.

However, when the matter is taken up for hearing, the learned Government Pleader appearing for the 1st respondent would submit that the issue involved in this writ petition is squarely covered by a Division Bench decision of this Court dated 06.08.2015 in W.A.No.1012 of 2013 and batch and that, therefore, the writ petitioner cannot escape the liability to pay the cess. Following the said judgment and for the reasons mentioned therein, this writ petition is dismissed in terms of the Division Bench judgment of this Court dated 06.08.2015 in W.A.No.1012 of 2013 and batch. No costs. Miscellaneous petitions, pending if any, in the writ petition shall stand closed.
