THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.24176 of 2016 ORDER:

Petitioner's grievance is that 3rd respondent had illegally detained a vehicle tipper bearing No.AP-25X5387 belonging to the petitioner since 18-05-2016 and is not at all releasing the same in favour of petitioner. 2.

Learned Government Pleader for Home appearing for respondents has stated on instructions that F.I.R.No.58 of 2016 was registered on 19-05-2016, that it was reported to the Judicial Magistrate of First Class, Nirmal and that the vehicle is in the custody of the said Court.

In view of the said submission, the granting liberty to the petitioner to file petition under Section 451 Cr.P.C. for seeking release of the vehicle pending investigation before the said Magistrate, the Writ Petition is disposed of. No costs.

4. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
