HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.2121 of 2014 ORDER:

This Contempt Case is filed alleging wilful and deliberate violation of the order passed by this Court in WP No.2121 of 2014 dated 06.06.2014 whereby the respondent was directed to consider the petitioner's representation, take a decision thereupon, and communicate the same to the petitioner at the earliest, and in any event not later than two months from the date of receipt of a copy of the order.

Along with the counter-affidavit is enclosed a copy of the proceedings of the Panchayat Secretary, Ananthavarapadu gram panchayat dated 15.09.2014 whereby, after considering his representation, the petitioner was informed that the matter was examined by the Gram panchayat, and an appropriate decision would be taken after a survey was caused.

Smt. K. Aruna, Learned Counsel for the petitioner, would contend that the respondents were required to take a decision; and the endorsement, informing the petitioner that action would be taken after a survey is caused, does not amount to a decision. The order passed by this Court, in W.P. No.2121 of 2014 dated 06.06.2014, merely required the respondents to consider the petitioner's representation, take a decision, and communicate the same to him. The decision communicated to the petitioner is that a survey would be caused and thereafter, depending upon the outcome of the survey, further action would be taken.

I am satisfied that the endorsement dated 15.09.2014 is an order passed in compliance with the order of this Court. I see no reason, therefore, to proceed against the respondent under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The miscellaneous petitions pending, if any, shall stand dismissed. No costs.
