THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.8320 OF 2012 ORDER:

Heard Ms. G. Sindhu, learned counsel for the petitioner and Assistant Government Pleader for Revenue appearing for the respondents.

The petitioner prays for Mandamus declaring the action of the respondents in interfering with petitioner's possession and enjoyment of an extent of Ac.0-11 cents in RS. No.69/3 of Anandapurm Village and Mandal, Visakhapatnam District, in the guise of widening the existing road without recourse to law as arbitrary, illegal and unconstitutional. On 26.03.2012 in WPMP No.10549 of 2012 this Court directed the parties to maintain status quo in respect of Ac.0-11 cents in RS.No.69/3 of Anandapuram Village and Mandal, until further orders. The Assistant Government Pleader for Revenue by referring to written instructions dated 27.03.2012 submits that the petition land admittedly is zyroithi land and the writ petition is filed on apprehension of respondents proposing to lay a road. According to the respondents, the Department is constructing drainage canal in Government land in Sy.No.68, but not in Sy.No.69/3.

Recording the statement of the Assistant Government Pleader, this Writ Petition is disposed of by making interim order final order, for, interim order deals with Sy.No.69/3. No order as to costs. Miscellaneous petitions, pending if any in this Writ Petition, shall stand closed.
