THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11691 OF 2016 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.
2. Petitioner's grievance is that he is the owner of the subject land; that he intended to sell the said land to some third party; but the 3rd respondent is not receiving the document for the purpose of registration and he is insisting for production of 'No Objection Certificate' from the revenue authorities.
3. The Government Pleader for Revenue appearing for respondents states that the 3rd respondent would receive the document presented by the petitioner and if the 3rd respondent does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document.
4. In view of the said submission, the Writ Petition is disposed of directing the 3rd respondent to receive the document presented by the petitioner without insisting for production of 'No Objection Certificate' from the revenue authorities, if submitted by the petitioner within a period of two (02) weeks from the date of receipt of a copy of this order; and if the 3rd respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks thereafter and communicate his decision thereon to the petitioner. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
