HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition Nos.5091 and 5153 of 2016 Common Order:
Both these revisions arose out of the refusal of the Trial Court to club 4 suits together and to take them for joint trial along with the 5th suit.
2. Heard the learned counsel on both sides.
3. There are 5 suits pending on the file of the same Court in which the petitioner in both the revisions is the sole defendant. Out of those 5 suits, 4 suits are filed by one Mr.
V.Satyanarayana.
The 5th suit is filed by one Mr. A.Krishna Mohan.
4. While it is possible to combine 4 suits between the same parties for joint trial, it is not fair to link a suit filed by a 3rd party to these 4 suits.
5. Therefore, these revisions are disposed of to the following effect: (1) All the 4 suits, namely, O.S.Nos.23, 29, 30 and 31 of 2016 filed by Mr. V.Satyanarayana against the petitioner herein may be taken up for joint trial and
(2) O.S.No.25 of 2016 filed by Mr. A.Krishna Mohan may be dealt with separately. The miscellaneous petitions, if any, pending in these revisions shall stand closed. No costs. ___________________________ V.RAMASUBRAMANIAN, J.
