Heard Sri V.K. Naidu, learned counsel for the petitioner, and Sri P. Balaji Varma, learned counsel for the respondent. The present transfer CMP, under Section 24 of the Code of Civil Procedure, 1908, is filed requesting to withdraw FCOP.No.2281 of 2017 from the file of II -Additional Family Court-cum-XV Additional District Judge, Kukatpally, and to transfer the same to the Court of the Senior Civil Judge, Bhimavaram, West Godavari District. Learned counsel for the petitioner would submit that the parties never resided at Kukatpally and they resided at Mumbai and, thereafter, there was desertion by the respondent. Learned counsel would also submit that, in fact, the petitioner is taking shelter at her parents' house at Bhimavaram, West Godavari District, and she apprehends threat to her life, as earlier there was an attempt to murder her by pressing pillow against her face, from which she could, somehow, escape.
The request of the petitioner appears to be genuine and it would be an arduous task for her to travel all the way to the II-Additional Family Court at Kukatpally. Therefore, FCOP.No.2281 of 2017 pending on the file of the II-Additional Family Court-cum-XV Additional District Judge, Kukatpally, is withdrawn and transferred to
the Court of the Senior Civil Judge, Bhimavaram, West Godavari District.
Accordingly, the transfer CMP is allowed. The transferee Court is directed to issue notices to both parties on receipt of case bundle and proceed in accordance with law. No order as to costs. Miscellaneous Petitions, if any pending in this petition, shall stand closed.
