This Criminal Petition is filed seeking the Court to enlarge the petitioner on bail, who is arrayed as accused in Crime No.52 of 2026 of Athmakur (S) Police Station, Suryapet District, registered for the offences punishable under Sections 78, 118(1), 115(2), 352, 351(2) of the BNS, 2023 (354 'D', 324, 323, 504, 506 of the IPC) and Section 11 r/w 12 of the POCSO Act, 2012.

The case of the prosecution is that, on 23.03.2026, the de-facto complainant, who is the mother of the victim, lodged a complaint before the police stating that that her daughter is studying 10th class, dropout and staying in the home and the petitioner herein stalking and harassing the complainant's daughter for some time, claiming that he loves her and intends to marry her. As marriage proposals began coming in for the complainant's daughter, he started threatening her, demanding that she not get married. On 22.03.2026 at about 03:00 PM while the complainant's daughter was taking her buffaloes to the village tank, in the meantime, the petitioner herein went to the tank area, used filthy language, beat with hands, footwear, kicked with legs on her abdomen and threatening her that not to marry anyone else and he would kill her if she marry anyone. Later, her daughter informed the complainant that he had also kicked her in the stomach. Hence, the complainant requested to take necessary action. Basing on the same, the police registered a case for the above said offences.

Heard Sri Veera Babu Gandu, learned counsel appearing on behalf of the petitioner as well as Sri M.

Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and the petitioner herein is a married person and only to harass the petitioner herein a false case is registered against him and he is in jail since 24.03.2026 and the material part of the investigation is already completed including the recording of the statement under Section 183 of the BNS. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner herein are serious and heinous in nature. It is further submitted that, inspite of the petitioner is a married person, he harassed the victim to marry him, as such, he is not entitled for bail. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since

24.03.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 12 have already been examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Sessions Judge, at Surypet.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3)

of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
