HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.19674 of 2009 ORDER:

Against a notice issued under Sections 42(1) and 43(1) of the Andhra Pradesh Urban Area (Development) Act, 1975, and Section 452 of the Hyderabad Municipal Corporation Act, 1955 dated 27.06.2009, the petitioner submitted their reply vide letter dated 20.07.2009. Alleging that the 2nd respondent, for extraneous reasons, was demanding that the petitioner should pay Rs.1.00 Lakh to him, the petitioner has invoked the jurisdiction of this Court contending that they had merely removed the tin sheet roof and had replaced it with an RCC roof above the building. The question whether the petitioner has violated the provisions of the aforesaid enactments is again a matter for the authorities to consider.

This Court would not take upon itself the task of examining all these matters, more so as the petitioner has submitted their reply to the show-cause notice and the respondents have not passed any orders thereupon till date. Suffice it to direct the respondents not to take any coercive steps against the petitioner herein till orders are passed on the petitioner's reply to the show cause notice dated 20.07.2009, and their decision is communicated to them.

The Writ Petition is, accordingly, disposed of.

The Miscellaneous Petitions pending, if any, shall also stand disposed of. No order as to costs.
