THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.25754 of 2008 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The petitioners have invoked the jurisdiction of this Court against the order of the A.P. State Human Rights Commission dated 04.09.2008 directing the State Government to pay Rs.50,000/- as damages, including a sum of Rs.10,000/- each from the five police personnel attached to Tiruvuru Police Station, Krishna District. The State Government was granted liberty to recover the said amount from the five police personnel, in reasonable instalments, from the salaries payable to them. Alleging that the said order was passed without giving them an opportunity of being heard, four of the five police personnel have invoked the jurisdiction of this Court.

A perusal of the impugned order shows that the order passed by the A.P.H.R.C. on 04.09.2008 is an interim order, and the matter was directed to be called thereafter on 10.11.2008. Sri G.Tuhin Kumar, learned counsel for the petitioners, states that the matter is still pending before the A.P. State Human Rights Commission. If that be so, it is always open to the petitioners herein to approach the A.P. State Human Rights Commission and seek modification of the order passed earlier.

Granting liberty to the petitioners to do so, the Writ Petition is dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed.
