HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5013 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.4 & 5 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.15 of 2015 of Women Police Station, Nellore, SPSR Nellore District, registered for the offences punishable under Sections 495, 498-A r/w 34 IPC and Section 3 & 4 of D.P. Act.

2) Heard learned counsel for the petitioners/ accused Nos.4 & 5 and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to 2nd respondent-de facto complainant. Perused the material on record.

3) A perusal of the material on record since falls short to admit the application to quash the FIR in Crime No.15 of 2015 (supra), the Criminal Petition is disposed of giving liberty to the petitioners, in the event of police filing final report and taking cognizance of any offence by the learned Magistrate to approach afresh for any appropriate reliefs. Since it is represented that even the petitioners are on bail, their presence is requiring by the learned Magistrate pending investigation for no purpose, the learned Magistrate is directed to dispense with their appearance pending investigation, so they can appear after filing of final report by police and on summons.

4) Consequently, miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
