THE HON'BLE SRI JUSTICE S.V. BHATT COMPANY APPLICATION No.121 OF 2016 IN COMPANY PETITION No.48 OF 2013 ORDER:

Heard Mr.Anil Kumar for applicant and Mr.D.V.A.S.Ravi Prasad. The respondents filed counter affidavit and the relevant portions of the counter affidavit read thus: "It is respectfully submitted that the respondent has not hidden anything from the knowledge of the applicant and has in a fair and just manner narrated all that is true and correct. The respondent has not visited the site at Khandwa after abandoning it. There is life threat for the respondent herein or any person who try to enter the work site at Khandwa on behalf of the company Askon Constructions Private Limited.

It is submitted that the entry books pertaining to the proof of the said scaffolding material lying at site were also left at the site office which has now been completely unattended since the last 4 years. Thus the respondent herein is completely handicapped in so far as furnishing any proof of purchase of the said scaffolding material.

Having regard to the stand taken in the counter affidavit, the applicant does not press the prayer and accordingly the Company Application is dismissed leaving it open to applicant to take further or appropriate steps as are required in law.
