HON'BLE SRI JUSTICE S.V. BHATT COMPANY APPLICATION No.1034 OF 2015 IN COMPANY PETITION No.184 OF 2013 ORDER:

The Official Liquidator prays for taking cognizance of offence against Ex-Managing Director etc. of company in liquidation on the ground that the Ex-Managing Director has not filed statement of affairs as required by law. The Official Liquidator filed report dated 28.01.2016. From the report dated 28.01.2016, it is clear that Ex-Managing Director of Company in liquidation submitted statement of affairs on 20.11.2015 and the Official Liquidator through letter dated 18.12.2015 called upon Ex-Managing Director to explain the queries raised by Official Liquidator in the letter dated 18.12.2015. The queries raised by Official Liquidator have been replied through communication dated 28.12.2015. Having regard to these developments, the prayer for taking cognizance is not pressed seeking liberty to file appropriate application as is warranted to take further steps on the reports filed by Ex-Managing Director.
