This writ petition is filed challenging the action of the 4th respondent in interfering with the personal life and liberty of the petitioners by calling the petitioners to the police station on several occasions and in threatening the petitioners with dire consequences without registering a crime and without issuing any notice under Section 41(A) of Cr.P.C.
Learned Assistant Government Pleader for Home basing on the written instructions dt. 09.07.2019 submitted by the Inspect of Police, Alwal P.S., Cyberabad Commissionerate, submits that on receipt of complaint from the wife of 1st petitioner, GD entry was made on 17.04.2019; that as the said issue is matrimonial issue, the Station House Officer informed the 1st petitioner to attend for counselling; that inspite of several intimations the 1st petitioner did not turn up before the Station House Officer and finally attended for counselling on 04.07.2019; and that the petitioner instead of attending for second counselling on 09.07.2019, filed this writ petition. The other allegations made by the 1st petitioner that respondent No.4 abused him in filthy language and asked him to stay in police station from morning to evening were all denied. It is to be seen that as on today, no crime is registered against the petitioners. In view of the same, recording the aforesaid written instructions, the writ petition is disposed of directing the respondent
police not to interfere with the life and liberty of the petitioners except in accordance with law. However, this order will not preclude the respondent police from investigating into any crime. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
