ORDER:

The petitioner claims to be the owner of property bearing Door No.20/1499 in CAS No.342, Nellore Bit-I, Macleans Road, Kotamitta, Nellore, SPSR Nellore District. The petitioner claims to have purchased the said property on 31.12.2012. The petitioner claims to have submitted an application for grant of building permission and as the application was not processed, without waiting for sanctioned permission, the petitioner started undertaking construction of the building. Apprehending that the respondents are going to demolish the building on the allegation of not granting permission, the petitioner filed W.P.No.23020 of 2014, which is pending consideration of this Court.

2. The petitioner claims that he has submitted an application for regularization of the building constructed by him in accordance with the Scheme formulated and notified vide G.O.Ms.No.128, Municipal Administration and Urban Development (M1) Department, dated 22.05.2015, but the respondents are not accepting the said application on the ground that the above writ petition is pending before this Court.

3. Sri Ancha Pandu Ranga Rao, learned Standing Counsel for the 2nd respondent Municipal Corporation points out that in accordance with the procedure envisaged in G.O.Ms.No.128, Municipal Administration and Urban Development

(M1) Department, dated 22.05.2015, the application for regularization has to be submitted online through the internet website. There is no question of submission of application physically nor refusal to receive such application, it appears that the petitioner has not submitted any application online.

4. Therefore, while granting liberty to the petitioner to submit application as per the procedure envisaged in G.O.Ms.No.128, Municipal Administration and Urban Development (M1) Department, dated 22.05.2015, the Writ Petition is disposed of.
