This appeal is filed by the defendant, under Section 100 of CPC, assailing the decree and judgment dated 27.12.1999 passed in A.S.No.28 of 1994 on the file of the Court of the Senior Civil Judge, Tadepalligudem, West Godavari District. 2.

At the time of hearing, learned counsel for the appellant submitted that the purpose of filing of the second appeal has become infructuous. The submission is recorded. 3.

Accordingly, the second appeal is dismissed as infructuous. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
