HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41488 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents 2 and 3 in interfering with the civil liberties of petitioners and directing to come to police station and in interfering with the construction activity undertaken by the petitioners, as illegal and arbitrary, and consequently, direct the respondents 2 and 3 to forthwith desist from interfering with the civil liberties of the petitioners. Heard and perused the material available on record. The case of the petitioners is that they are making construction in plot No.43 in Sy. No.91/ Part, situated at Shiva Enclave, Old Boinapally, Balanagar Mandal, Ranga Reddy District, after obtaining necessary permission from the GHMC. While construction work is going on, some persons, who have dispute with the vendor of the petitioners, approached the respondents 2 and 3 and at their instigation, the respondents 2 and 3 are interfering with the civil activities of the petitioners.

Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.

Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

The respondents 2 and 3 are directed not to call the petitioners to the police without there being any case for a

cognizable offence, against the petitioners and not to interfere with the civil activities of the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J November 30, 2016 KTL
