THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11435 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.169 of 2015 on the file of Dachepalli Police Station, Guntur District, registered for the offence punishable under Section 420 IPC.

Heard and perused the material available on record. It is alleged that the de facto complainant gave contract to the petitioner for supplying manpower for Contingent and Corrective jobs for the works of Durga Cement Works of Andhra Cements Limited in Durgapuram, Dachepalli and issued two work orders. Even though the petitioner has collected money from the de facto complainant towards wages to be paid to the workers, he did not pay the same to the workers and he absconded, as a result of which, the de facto complainant suffered loss.

Considering the facts and circumstances of the case and in view of the specific allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
