THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.13141 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an order or direction more particularly one in the form of Writ of Mandamus to declare the action of the respondents in not provding Pay for the deputation period to undergo M.Sc., (Horticulture) on deputation basis as in service candidates is illegal, arbitrary, unconstitutional and in violative of Principles of Natural Justice, and consequently direct the respondents to pay the pay and allowances for the deputation period to undergo M.Sc. (Horticulture) on deputation basis as in service candidates with all consequential benefits and pass such other and further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard Sri N.Ramesh, learned counsel, appearing for the petitioner, apart from perusing the material available on record.

3. When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 22.06.2015 to the 1st respondent herein and no orders have been passed on the said representation so far and a copy of the same is also placed on record. It is further requested by the learned counsel that necessary direction may be issued to the respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any

opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 1st respondent herein to consider and pass appropriate orders on the representation dated 22.06.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.
