HONOURABLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 9624 OF 2015 ORDER:

Heard learned Counsel for the petitioners and the learned Government Pleader.

The petitioners complain against the action of second respondent in refusing to receive and register the lease deed dated 27.12.2012 presented by the petitioners for an extent of Ac.0.80 cents in Sy.Nos.140/2, 140/5, Sub No.10 (Old Sy.No.808/K2 of Kothur village), Kurnool village and Mandal as illegal, arbitrary and unconstitutional.

The complaint as is evident from the prayer is one of inaction of the second respondent. The petitioners rely upon the

orders of this Court in Writ Petition Nos. 17137 of 2013 and 40554 of 2014 to contend that this Court has considered similar grievance against second respondent in respect of the land in Sy.Nos.140/2 and 140/5 of Kurnool village and Mandal and directed the Registrar to receive and consider the same for registration and if any objection is there, communicate the same to the party. On 07.04.2015 at the request of the learned Government Pleader, the matter is directed to be listed today. The learned Government submits that he does not have instructions in the matter. From the material available on record, he states that in Writ Petition No.40554 of 2014, this Court has considered the inaction and directed the Registrar to receive the document and pass appropriate orders. Having regard to similarity of cause in these two writ petitions, Writ Petition is ordered by following the order of this Court in Writ Petition No.17137 of 2013.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
