THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.952 of 2017 ORDER:
The present Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners - accused Nos.1 to 5 viz., Byagari Narasinga Rao, Byagari Krishna, Byagari Sri Ramulu, Byagari Gopal and Byagari Murali, requesting to quash the proceedings against them in First Information Report No.25 of 2017 of Raidurgam Police Station, Cyberabad, for the offence punishable under Section 447 read with 324, 506, 34, 420, 467, 468, 471 and 474.

Sri K.V.Bhanu Prasad, learned counsel for the petitioners, having argued that the victim, who is alleged to have been beaten by the petitioners herein, has not approached the police directly by filing a complaint and some third person came and filed a complaint, basing on which criminal action has been initiated, would, however, represent that let the Investigation Officer fairly conduct investigation and then file a report. On the other hand, learned Additional Public Prosecutor while submitting that the victim, who is a watchman, was sent for treatment and medical report is awaited, requested to adjourn the matter.

Since the learned counsel for the petitioners has expressed no grievance for conducting investigation and when pointed out that there is no bar in reporting the commission of cognizable offence to the police concerned by a stranger, who may not be a victim, the learned counsel for the petitioners made a statement
that Investigating Agency has to conduct fair investigation. In such an event, the petition has to be disposed of. 5.
Accordingly, the Criminal Petition is disposed of. It is needless to observe that in case the petitioners have any material, the same shall be placed before the Investigation Agency during the course of investigation.
