THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 40244 of 2014 ORDER:
This Writ Petition is filed for the following relief: "...to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in calling the petitioner frequently to the police Station by the respondents 3 to 5 is illegal arbitrary violation of Fundamental Rights guaranteed under the Constitution of India and without Jurisdiction and consequently direct the respondents not to call the petitioner to the police station of respondents 3 to 5 frequently."
Learned Assistant Government Pleader for Home has produced before this Court the written instructions issued by the fourth respondent - Sub-Inspector of Police, Medak Town Police Station, Hyderabad, and stated that no complaint is received or registered against petitioner on the file of Medak Town Police Station; the petitioner is not at all required in any case registered on the file of Medak Town Police Station and at any point of time, he was summoned by the respondent police and thereby, prayed for dismissal of this Writ Petition.
In those circumstances, this Writ Petition is disposed of with the direction to the respondents that without there being any crime registered against the petitioner and without following the procedure prescribed in law, the petitioner shall not be harassed
CKR, J W.P.No.40244 of 2014 in any manner either by calling him to the Police Station or otherwise.
Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
