The petitioner prays for the following relief :- " .......... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents No. 1 & 2 in not investigating and not taking necessary action on the complaint made by the petitioner in Crime No. 166 of 2012 dated 20-10-2012 of Mulug Police Station, Warangal District is arbitrary and illegal ......" The Assistant Government Pleader places on record final report dated 19-05-2013. The relevant portion reads as follows:- " Hence, LW.19/ SDPO, Mulug submitting the final report treating the case as " Civil Nature & Sub-Judice" with a pray to treat the case as " Civil Nature & Sub-Judice" and issue proceedings accordingly. Acknowledged copy of the Notice to complainant served on the complainant and order of Suptd.

of Police, Warangal Rural are herewith enclosed." From the above, it is clear that not only final report was filed but a copy was also served on the complainant/ petitioner. Hence, this Court is of the view that the petitioner is not coming forward to work out the writ prayer.

By placing on record the final report, the writ petition is dismissed. No order as to costs.
