HON'BLE SRI JUSTICE R. SUBHASH REDDY AND HON'BLE DR. JUSTICE B. SIVA SANKARA RAO FAMILY COURT APPEAL No.143 of 2005 ORDER : (Per Justice R. Subhash Reddy) This appeal is filed under Section 19 of the Family Courts Act, by the respondent in F.C.O.P.No.208 of 2004, aggrieved by order dated 20.06.2005, passed by the Family Court, Secunderabad, allowing the petition filed by the respondent herein under Section 9 of the Hindu Marriage Act for restitution of conjugal rights. Though this appeal was filed in 2005, it underwent several adjournments on earlier occasions at the request of the learned counsel for appellant. Recently, when it was listed on 28.01.2015, it was adjourned by two weeks at the request of counsel for appellant and when it was listed on 11.02.2015, again adjourned by one week. Today when the matter is called in the forenoon and afternoon sessions, there is no representation on behalf of appellant.

In the aforesaid circumstances, this Court is of the view that the appellant is not interested in pursuing the matter. Therefore, the appeal is dismissed for nonprosecution. No order as to costs. Pending miscellaneous applications, if any, shall stand closed.
