Yeduru Venkata Ramana S/O.Bhaskar Reddy, v. The State Of Andhra Pradesh Rep. By Its Principal
HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.39075 of 2015 Date:02.12.2015 Between:
Yeduru Venkata Ramana, S/o Bhaskar Reddy ..... Petitioner And:
The State of A.P.., reptd., by its Principal Secretary,MA & UD Department Hyderabad and two others.
.....Respondents Counsel for the Petitioner: Mr. G.L.Nageswara Rao Counsel for Respondent No.1: AGP for MA & UD (TS) The Court made the following:
ORDER:
The petitioner, in whose favour lease was granted on 10.6.2004 for running a Gymnasium in Phase-1, VUDA Park, Visakhapatnam for a period of three years, filed this Writ Petition feeling aggrieved by the purported action of respondent No.2 in seeking to evict him from the leased premises.
A perusal of the proceedings, dated 10.6.2004, issued by respondent No.2 shows that the lease was initially granted to the petitioner for a period of three years extendable to a maximum period of nine years. Thus, as per this condition, the maximum period for which the petitioner is entitled to hold the lease expired on 10.6.2013. Therefore, the petitioner cannot have legitimate grievance against his proposed eviction.
For the above-mentioned reasons, the Writ Petition is dismissed. As a sequel to dismissal of the Writ Petition, W.P.M.P.No.50375 of 2015 shall stand dismissed as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 02nd December, 2015 DR
