This writ petition is being disposed of at the admission stage with the consent of both parties.

This writ petition is filed seeking a Writ of Mandamus declaring the action of the 3rd respondent in not disposing of the appeal filed by the petitioner on 02.12.2016 against the order of dismissal from service, dated 17.10.2016, as illegal, arbitrary, contrary to law and violative of Articles 14 and 21 of the Constitution of India and sought a consequential direction to the respondents to dispose of the appeal preferred by the petitioner within the time frame fixed. 3.

Heard Sri K. Ramesh Reddy, learned counsel for the petitioner, learned Government Pleader for Agriculture and Sri P.Srinivasa Rao, learned Standing Counsel for respondent Nos.3 and 4. 4.

It has been contended by the petitioner that he was working as Assistant Manager/Field Officer with the respondent Bank-The Karimnagar District Co-operative Central Bank, Karimnagar and while he was discharging his duties, the disciplinary authority has initiated disciplinary proceedings and imposed penalty of dismissal from service, vide orders, dated 17.10.2016, for the alleged financial irregularities. The petitioner further contends that he has preferred an appeal to the appellate authority on 02.12.2016, but so far the appellate authority has not passed any orders on the appeal.

Therefore, learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the appellate authority to dispose of the appeal preferred by him on 02.12.2016 within a reasonable period of time.

Learned Government Pleader as well as learned Standing Counsel appearing for the respondents had submitted that the case of the petitioner would be considered and appropriate orders would be passed on the appeal preferred by the petitioner on 02.12.2016 in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the appellate authority i.e., the 3rd respondent to consider the appeal preferred by the petitioner on 02.12.2016 and pass appropriate orders, in accordance with law, within a period of four months from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
