HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.5357 of 2021 O R D E R:

This petition is filed under Section 439(2) Cr.P.C., seeking cancellation of bail granted by this Court by order dated 02.11.2020 in Crl.P.No.4233 of 2020.

This Court, while granting bail to the respondents/A1 to A4, has imposed condition No.(ii) that they shall appear before the Station House Officer, Bhadrachalam Town Police Station, Bhadradri-Kothagudem, on every Sunday between 10.00 am and 5.00 pm., till completion of investigation and filing of final report.

Learned Assistant Public Prosecutor submits that after obtaining orders from this Court, A1 appeared before the Station House Officer till 14.03.2021, A2 appeared till 07.02.2021, A3 appeared till 18.04.2021 and A4 appeared till 21.03.2021, but later they did not appear before the Station House Officer and the investigation could not be completed. He submits that after enlarging on bail, the respondents have involved in other case in Cr.No.232 of 2021 of Bhadrachalam Town Police Station, under Section 8(c) read with 20(b) of NDPS Act. He further submits that as the respondents have violated the conditions and also involved in similar offences, bail granted to them has to be cancelled.

When the matter came up on 21.01.2022, 24.01.2022 and 02.02.2022, there was no representation on behalf of the respondents. Though Mr. G. Ramachandra Reddy, learned counsel, has filed vakalat on behalf of the respondents, he failed to appear on the said dates. 5.

In view of the submission of the learned Assistant Public Prosecutor that the respondents have failed to comply with the condition imposed by this

Court in the bail order and also involved in other offences, the bail granted to them by order dated 02.11.2020 in Crl.P.No.4233 of 2020 is cancelled. 6.

Accordingly, the Criminal Petition is allowed. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
