HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19933 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 3 to 5 in interfering with the petitioner's peaceful possession and enjoyment of plots in Survey No.283/1, plot bearing Nos.16, 17, 20, 21, 23, 24, 25, 26, 27, and 28, situated at Panchalingala Village, Kurnool Mandal, Kurnool District, which was purchased by the petitioner through registered sale deed document No.5435/2014, dated 20.08.2014 and sale agreement dated 19.12.2014 from his vendor and trying to dispossess the petitioner from the above land/plots without following due procedure, with the instigation of respondents 6 to 9, though transactions in the above Survey No.283/1 are prior to the year 1974, as illegal and arbitrary and for a consequential direction to the respondents not to interfere with the petitioner's peaceful possession and enjoyment and not to dispossess the petitioner from the aforesaid land.

Learned Assistant Government Pleader basing on the counter filed by respondent No.4 states that the revenue authorities are not interfering with the possession and enjoyment of the petitioner over the aforesaid property. Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, this will not preclude the Endowments Department from defending WP.No.40253 of 2014. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
