THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.11950 of 2018 ORDER: (per SK,J) Challenge in this writ petition is to the order dated 27.03.2018 passed by the Debts Recovery Tribunal-II, Hyderabad, in I.A.No.1262 of 2018 in S.A.No.131 of 2018.
By the aforestated order, the Tribunal granted conditional stay of the auction sale proposed to be held on 28.03.2018 pursuant to the e-auction sale notice dated 23.02.2018 subject to the petitioner-applicant depositing certain amounts within a time frame. Aggrieved by this condition, the petitioner-applicant filed this writ petition. While so, Sri P.V.Uma Shankar Rao, learned counsel for the Andhra Bank, would inform this Court that the auction sale proposed to be held on 28.03.2018 failed for want of bidders.
In that view of the matter, the grievance with regard to the conditions imposed by the Tribunal in relation to the said auction sale no longer need to be acted upon and the challenge thereto is rendered purely academic.
The writ petition is accordingly dismissed on the said ground. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
