This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 3 in Crime No.53 of 2026 of Alladurg Police Station, Medak District, registered for the offences punishable under Sections 108 r/w 3(5) of the BNS.

The case of the prosecution is that, on 16.04.2026, the de-facto complainant, who is the wife of the victim, lodged a report before the police stating that they had inherited plot admeasuring 120 Sq.yds in Jagadgirigutta, Hyderabad and so also Ac.6.20 gts agriculture land in Mupparam village, Medak District, from their parents-in-laws and her elder brother-inlaw owns an extent of Ac.2.20 gts and she further stated that there are disputes between her husband and her elder brother-in-law with regard to the properties and the victim requested the petitioners herein for registration of the said property in his name and several times he requested, but they are troubling the victim, due to which, he committed suicide by recording the statement in the video. Hence, the complainant requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences.

Heard Sri C. Pratap Reddy, learned Senior counsel representing Sri C. Sunil Anand, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent - State.

Learned counsel for the petitioners submitted that the petitioners herein are family members and A.1 is the husband of A.2 and A.3 is the daughter. It is further submitted that, in fact, the petitioners herein gave shelter to the victim in their house and initially, he gave the rent, later, he has not given any rent. It is further submitted that the petitioners herein filed a suit and gave the possession of the said property to A.3 and earlier, there are disputes between the parties, which itself shows that the petitioners herein are falsely implicated in the present case and they are ready to cooperate with the investigating authority. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by learned counsel for petitioners stating that the allegations against the petitioners are serious in nature and prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it appears that the averments in the complaint shows
that there are property disputes between the parties and the petitioners herein have filed documents and earlier there are disputes between the parties. Considering the facts and circumstances of the case and also the documents filed by the petitioners herein, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions: i.
The petitioners shall surrender before the Station House Officer, Alladurg Police Station, Medak District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
