This criminal petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in connection with C.O.R. No. 35 of 2022 on the file of Station House Officer, Prohibition and Excise Station, Narayankhed, Sangareddy District, wherein the petitioner/Accused No.1 is alleged to have committed the offence punishable under Section 8(C) read with Section 22(C) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Heard the learned counsel for the petitioner/Accused No.1 and the learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

The petitioner is Accused No.1 from whom 1.150 kgs of Alprazolam was seized. Since the seized quantity is commercial quantity, the petitioner/Accused No.1 is not entitled for bail, however, the learned senior counsel has drawn the attention of this Court the medical condition of the petitioner, wherein the petitioner was operated thrice due to cardiac problems and stents were implanted. The petitioner/Accused No.1 was taken to the

Crl.Petition No.3570 of 2022 government hospital on 24.03.2022, 02.04.2022, 08.04.2022, 12.04.2022 and 16.04.2022 for the purpose of treatment and the doctor suggested that he should be admitted into super specialty hospital for the purpose of treatment.

Keeping in view the medical condition of the petitioner/Accused No.1, the petitioner/Accused No.1 is directed to be released on Interim Bail for a period of 4 weeks i.e. from 29.04.2022 on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Narayankhed, Sangareddy District and he shall surrender before the concerned Court 27.05.2022. In the event of the petitioner/Accused No.1 is unable to surrender on the said date, in any unforeseen circumstances, the said proof shall be file before the concerned court.
