THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12986 of 2011 ORDER:
The grievance of the petitioner in this case was that the SubInspector of Police, Rolugunta, Visakhapatnam District, was harassing him by registering false cases apart from maintaining a rowdy sheet in his name. As personal allegations were made against the SubInspector of Police, the petitioner also impleaded him by name as the 4th respondent.
However, Sri Jithender Rao Veeramalla, learned counsel for the petitioner, states that notice was not ordered to the 4th respondent by this Court and he is no longer in service at present, having attained the age of superannuation. Learned counsel therefore states that the writ petition is being given up insofar as the 4th respondent is concerned.
Insofar as the issue of the rowdy sheet in the name of the petitioner is concerned, the Assistant Superintendent of Police, Narsipatnam Sub-Division, Visakhapatnam District, filed a counteraffidavit stating that the petitioner was involved in three criminal cases, out of which he was acquitted in one and bound over in another for good behaviour. The third case was pending on the file of the learned Additional Judicial First Class Magistrate, Narsipatnam, Visakhapatnam District. He further stated that the Sub-Inspector of Police, Rolugunta, had submitted proposals for opening of a rowdy sheet in the name of the petitioner whereupon the Assistant Superintendent of Police, Narsipatnam, Visakhapatnam District, accorded permission under proceedings dated 22.02.2011. The Assistant Superintendent of Police further stated that the rowdy sheet was extended up to 31.12.2015 and that it was necessary to maintain the same in the light of the petitioner's involvement in criminal activity. Sri Jithender Rao Veeramalla, learned counsel, fairly stated that
as the criminal case was still pending before the competent criminal court, liberty may be given to his client to renew his request for closure of the rowdy sheet by making an appropriate representation to the Assistant Superintendent of Police, Narsipatnam, Visakhapatnam District, after disposal of the criminal case. Recording the said statement, the writ petition is closed giving liberty to the petitioner to renew his request for closure of the rowdy sheet in accordance with the norms at the appropriate time. Pending Miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
