THE HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13982 of 2019 ORDER:

This writ petition is being disposed of at the admission stage with the consent of both parties.

This writ petition is filed seeking a writ of Mandamus directing the 2nd respondent to release the pay and allowances of the petitioner for the period from 07.01.2019 to 17.02.2019 in view of the order of the suspension being set aside and sought a consequential direction to the 2nd respondent to consider the request of the petitioner to post her in the Head Office of Director of Public Health and Family Welfare, Hyderabad.

Heard Sri K. Anantha Rao, learned counsel for the petitioner and learned Government Pleader for Services-II. 4.

It has been contended by the petitioner that she is working as Senior Assistant with the 2nd respondent and she was prevented from discharging her duties from 07.01.2019 to 17.02.2019 on the alleged ground that she was placed under suspension. The petitioner further submits that no suspension order was served on her and finally the disciplinary authority, vide orders, dated 16.02.2019, revoked the suspension and issued a warning to be careful in the future. The grievance of the petitioner is that the period from 07.01.2019 to 17.02.2019 is not being regularized and no salary is paid to the petitioner for the above said period. In those set of circumstances, the

petitioner has submitted a representation on 12.03.2019, but, so far, the respondents have not passed any orders on the said representation nor regularized the so-called suspension period. Therefore, learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for the respondents had submitted that the case of the petitioner would be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law.

This Court, having considered the rival submissions of the learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation, dated 12.03.2019, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
