HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2237 OF 2017 ORDER:

This writ petition is filed for a writ of mandamus declaring the action of the respondents in trying to demolish the house bearing No.13-1-1139/S situated in Shivlal Nagar, Upper Dhoolpet, Hyderabad, without following due procedure contemplated under law, as illegal and arbitrary. Heard both sides.

Admittedly, petitioner filed suits in O.S.No.2466, 2506, 2522 and 2743 of 2004 on the file of Senior Civil Judge, City Civil Court, Hyderabad in respect of same subject matter in the present writ petition. Petitioner also made a representation on 18.11.2012 admitting the same. Though it is suppressed in the affidavit conveniently, the same has been brought to my notice by the learned Assistant Government Pleader for Revenue. In view of the above facts and circumstances, petitioner cannot simultaneously initiate parallel proceedings by way of writ petition and civil suits in respect of the same subject matter. Hence, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed. There shall be no order as to costs.
