Heard learned counsel for the petitioners and also the learned Assistant Government Pleader for Land Acquisition representing respondent Nos.1 to 5 and before notice to unofficial respondent No.6.
It is the representation by the learned Government Pleader from the written instructions submitted before the Court that so far no award is passed and after passing of final orders of ROR case between the 6th respondent and the petitioner pending before the RDO, the 4th respondent to the writ petition, the compensation will be given.
In fact the petitioners' claim is that they are also entitled to apportionment of compensation for their share, which is subject matter of the suit in O.S.No.141 of 2015 on the file of Additional District Judge-cum-Judge, Family Court, Khammam. The suit is under contest. The Land Acquisition Officer after award, before the payment of compensation, from any rival dispute, can invoke the provision of Sections 75 & 76 of the Act No.30/2013. With these observations, the Writ Petition is disposed of, to workout any of the rights before the respondents. Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
