THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.2147 of 2010 ORDER:

This Writ Petition is filed for the following relief. "... to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent in collecting lease amount for a period of 12 months during the first year and not permitting the petitioner to enjoy the leasehold rights from 01.06.2009 till 17.11.2009 in respect of Madduru Sand Reach, Kankipadu Mandal, Krishna District on the ground of construction of new bridge/repairing the old bridge, though the lease deed was executed on 01.06.

2009 and in not giving permission to enjoy the said period as arbitrary, illegal, unjust, violative of principles of natural justice, failure to exercise power, violative of the fundamental rights guaranteed to the petitioner under Articles 14 and 19 of the Constitution of India and consequently direct the respondents to permit the petitioner to enjoy the remaining days in the first year lease period in lieu of the period from 01.06.2009 to 17.11.2009 and pass such other order or orders as are deemed fit and proper in the circumstances of the case." In view of expiry of the lease period, nothing survives for adjudication in this Writ Petition.

Hence, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

The miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
