HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.5366 OF 2021 ORDER:
The Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner seeking to grant anticipatory bail in connection with an un-registered crime.
Heard the learned counsel appearing for the petitioner, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.
Learned Assistant Public Prosecutor submits that no crime, as yet, is registered against the petitioner. Learned counsel for the petitioner submits that the police, P.S. Choutuppal, Yadadri District, are harassing the petitioner without any reason and the petitioner is apprehending arrest and if the petitioner is arrested, he would be put to irreparable loss and his reputation in the society would be damaged.
However, since there is no ground made out with regard to apprehension of the petitioner that a case would be registered against him, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner.
In view of the above, the Criminal Petition is disposed of with a direction to the petitioner to file an appropriate application in case any case is registered against him. Miscellaneous applications, if any, pending shall stand closed.
